The applicability of the clarifications of the Decree of the Plenums of the Supreme Court of the Russian Federation and the Supreme Arbitration Court dated 01.07.1996 No. 6/8 On Certain Issues Related to the Application of the Part One of the Civil Code of the Russian Federation to the relations established before 23.06.2015, when resolving disputes after this date, was confirmed.
It was also confirmed that if the mortgagor does not have rights to the plot, the mortgagor is not required to take steps to obtain such rights in order to pledge a building. The case was lost by the client in all cassations, and won by Avelan lawyers in the JCED SC of the RF.
