CORE OF THE CASE

The Arbitration Court of the Rostov Region resolved a disagreement between the bankruptcy trustee and creditors by establishing that UTender LLC (INN 6164265896) would become the electronic trading platform (ETP) for bidding on the bankrupt’s property. The initial price for the sale of the debtor’s property as a single lot and a production and technological complex was determined.

We proved that the lower initial sale price of the debtor’s property established by the court directly violated the interests of the debtor’s bankruptcy creditors (Articles 134, 138 of the Bankruptcy Law).
Additionally, we proved that the trial court did not provide evidence confirming that the electronic bidding platforms proposed by the pledge creditor would negatively affect the possibility of obtaining the maximum price from the sale of the pledged property.
