CORE OF THE CASE

Our client, a Hong Kong-based company, lent over RMB 55 million to a Russian company in 2015. After numerous demands for repayment, the company went to court in 2022. The Russian company claimed that it had missed the three-year deadline for the claim and demanded a complete waiver. The plaintiff risked losing the principal and interest amounting to 30 million yuan due to the total claim amount of 1,142,537,633.64 rubles.

SCOPE OF SERVICES

• We convincingly argued in court that the defendant, through its actions, led the plaintiff to believe that the debt would be paid without going to court, and that the plaintiff acted honestly in granting the installment plan.
• Developed and implemented the position that statute of limitations defenses should not work in favor of a bad faith defendant.

ACHIEVEMENTS, RESULTS, IMPORTANCE, SIGNIFICANCE OF THE PROJECT

As a result of the legal strategy we developed, the plaintiff and defendant entered into a settlement agreement whereby the defendant settled its debts to the plaintiff in a short period of time.
The outcome of the case proves that foreign companies can count on the protection of their interests in Russia, which in turn contributes to the improvement of the investment climate in Russia.
