As a result of successful actions to challenge previously concluded and approved amicable agreements in court and effective objection to the inclusion of claims on the register, we were able to ensure that independent creditors maintain control over the bankruptcy procedure and prevent non-existent claims from being included on the register.
Core of the Case
The false creditor tried to get included in the register of claims of the debtor’s creditors, claiming that he had previously transferred several vessels to the debtor for use, and the debtor, in turn, did not pay the freight. Inclusion of claims in the register would allow a group of affiliated companies to make important decisions at a meeting of the debtor’s creditors.
Scope of Services
Challenging previously concluded voluntary settlement agreements between the debtor and the creditor (applicant) in the court of cassation. Objection to the inclusion of claims in the court of first instance and the court of appeal: preparing a position, collecting evidence, speaking in courts.
