CORE OF THE CASE

Within the framework of a company’s bankruptcy case, the authorized body applied to the arbitration court with a petition to invalidate the lease agreements concluded between the plaintiff and our client. In addition, there was a discrepancy in the distribution by the bankruptcy trustee of the funds received under the lease agreement for the repayment of claims of the pledge creditor and the application of the consequences of invalidity in respect of payments for the distribution of funds.

The court resolved disagreements over the distribution of the bankruptcy estate proceeds from leasing the pledged property.
