Core of the Case
The court decision that entered into force on reclaiming real estate from unlawful possession was not executed by bailiffs for more than six months. The court had to intervene in the inaction of the bailiff. The task was to file a claim against the bailiff service with the aim of recognizing their inaction as illegal and imposing by the court an obligation to perform specific actions necessary for the execution of a judicial act.
