RESULT:

The client was tasked with ensuring that leases for the new shopping centre were executed in the shortest possible timeframe (weeks), negotiating and securing more than 30 lease agreements, including with Sberbank, jewellery stores, etc.

 

Core of the Case

The client set the task to ensure in the shortest possible time (weeks) the registration of lease relations in the new shopping center, to coordinate and ensure the conclusion of more than 30 lease agreements, including with Sberbank PJSC, jewelry stores, etc.

At the same time, each of the tenants intended to rent space on their own terms and using their own contract form, so everyone had their own contract, and each amendment had to be coordinated in detail with each tenant.
This led to a large amount of coordination and other work (which unacceptably delayed the conclusion of contracts), downtime of space and losses for the landlord.
The goal is to ensure the conclusion of lease agreements for the maximum area in the shopping center as soon as possible.

 

Scope of Services

In order to optimize work during the analysis, adjustment and approval of draft contracts provided by future tenants, a system of essential and minimum required conditions was developed and determined with the client, and we had to ensure that these conditions were included in the contracts being drawn up.
Thanks to the well-developed system of approach to the analysis and approval of agreements, we managed to agree and conclude agreements with all the declared tenants in record time.

 

Achievements, Results, Importance, Significance of the Project

The importance for the client lies in the fact that such a short (but very capacious) agreement really allowed the landlord to formalize contractual relations with all its tenants in record time and lease almost all of the premises by the opening of the shopping center. The rental business is the main activity of the client, and the downtime of such a large area would lead to significant losses.
This agreement has become an example of how much even minor changes in judicial practice and legislation can simplify business relations in the case of a comprehensive and thoughtful use of these changes in their relationship.
The significance of such projects for the legal system as a whole lies in that they allow to improve the processes of registration and conclusion of agreements and demonstrate that the parties do not really need to reflect as much information and provisions in contracts as it is usually done.
