This project is significant from the perspective of recognising the provisions justifying the RF House claims as unconstitutional and balancing the interests by arguing for tenant compensation.
Core of the Case
Dom RF applied to the court for early termination of the lease agreement with our client Siberian Agrarian Group”,, using the grounds in law for unmotivated termination of the contract with the tenant when transferring objects under the management of Dom RF. The lease agreement was concluded for 25 years, our client (the tenant) made significant investments in the modernization and improvement of the building. Our lawyers managed to achieve the transfer of the case to exclusive jurisdiction and overcome contractual jurisdiction.
Scope of Services
Preparation of a legal opinion and advice on the termination of a lease agreement, development of a client protection strategy in the Constitutional Court of the Russian Federation, challenging non-normative acts of the Government of the Russian Federation in the Arbitration Court.
