Collection of debts under loan agreements, including penalties (on the principal debt amount, on loan interest) in full – for the entire period of default by the debtors in the performance of obligations. We were faced with the task of proving the fact of the conclusion of loan agreements, as well as the fact that the subsequent signing of additional agreements by the head of the debtor’s company to the loan agreements should be qualified as approval of transactions concluded by the representative of the debtor’s company by the power of attorney (in the absence of a copy of the power of attorney).

Scope of Services

First of all, the lawyers collected a set of documents to confirm the fact of funds transfer: payment orders, account statements. There were presented calculations of indebtedness under loan agreements: principal debt, interest, penalty on principal debt and interest.

Achievements, Results, Importance, Significance of the Project

The claim was satisfied in full, including in terms of the entire penalty amount. Funds were collected from related debtors in favor of Z-Progress OOO (client) in the total amount of 207,000,000 rubles.
