The Internet magazine about business in Russia "The secret of the firm" has published legal recommendations of Maxim Poturaev, head of projects of Avelan Law Firm, on how former spouses can properly settle debts to credit organizations.
The lawyer explained in detail the concept of jointly acquired property, which laws regulate the division of such property and cited the most typical cases from court practice.
"The law does not take into account which spouse the loan was executed in: as a general rule, all money goes to family needs, therefore, joint debts in a divorce are subject to partition," says Maxim Poturaev.
