The licensee demanded compensation in the amount of 40,000,000 rubles from the licensor for contract violation. The defendant insisted that the licensee was not entitled to claim compensation. By decision of the Court for Intellectual Property Rights dated 22.01.2019, the consideration of the case on attempts to recover compensation in the amount of 40,000,000 rubles from Alexander Maslyakov’s company for violation of exclusive rights to KVN television programs was completed. Judicial acts on dismissal of the claim were upheld. The decision was based on the firm’s lawyers position

Achievements, Results, Importance, Significance of the Project

We achieved a decision to completely dismiss the claim against the copyright holder. The Arbitration Court agreed that the licensee was not entitled to claim compensation under Article 1301 of the Civil Code of the Russian Federation. Satisfaction of the claim would entail significant financial losses for the defendant and would jeopardize the subsequent existence of the famous TV show. The defendant in the case is the copyright holder and producer of the famous Russian show – KVN (Club of the Funny and Inventive). In turn, the lawyers of the firm consolidated the position in the Intellectual Property Court that the licensee was not entitled to recover compensation from the copyright holder.
